An Injunction Against Harassment prohibits a person from harassing, annoying or alarming another person. An injunction can be filed against neighbors, strangers, co-workers. The person filing the injunction is called the plaintiff. The person against whom the injunction is filed is called the defendant.
Injunction Petitions must be started online. Using a web browser, navigate to the AZPoint, follow the instructions to create an account and start a petition. Be sure to answer all of the questions on the petition. Your screen will display a confirmation number once you have completed your petition and it has been submitted to the Court. Please write down your confirmation number and bring to any of the Courts listed below between 8:00 AM - 4:30 PM, Monday through Friday.

Once you have established an account on AZPOINT and completed all of the questions, the option to "Make Court Ready" and "Save Petition" will appear. These options will not appear if you have not filled out all of the required information. An Injunction Against Harassment can only be issued against one person. If you intend to ask for protection from multiple people, a separate petition must be filed for each person. There is no fee for filing an Order of Protection. Once you have completed your petition, clicked on the "Make Court Ready" and "Save Petition" buttons, a confirmation number will be displayed on your screen, indicating that your petition has been filed. Print out this screen or write down the confirmation number as you will need it to proceed. At this point you will need to visit one of the courthouses indicated above along with your confirmation number so that the Clerks can review your petition. You will be scheduled that same day to go before a judge who will review your petition and either grant or deny the Injunction Against Harassment. In certain cases, the judge may schedule a subsequent hearing with both parties prior to ruling on the Injunction Against Harassment.
If the judge grants the injunction, a member of the clerk's staff will complete the paperwork for you. The defendant must be served with the injunction before it becomes effective. Court staff will explain how to have the defendant served. There is a fee involved for service by the Sheriff. You may apply to have your service fees waived or deferred. Once an order has been served, it will be in effect for twelve (12) months. It is important to keep a copy of the injunction with you at all times.
The defendant may file a petition to request that the injunction be modified or dismissed. If a petition is filed, the hearing will be heard in City Court or Pima County Consolidated Justice Court. The court location is determined by the location of the plaintiff's residence, either city or county. The court will mail a copy of the notice of hearing to the plaintiff specifying the location, date and time of the hearing.
If the plaintiff is a minor, the petition must be filed by the parent, legal guardian or the person who has legal custody of the minor. Any injunction sought against a person who is less than twelve years of age must be filed in the Juvenile Court.
